WE ENCOURAGE YOU TO READ THESE TERMS CAREFULLY AND TO CONTACT US IF YOU HAVE ANY QUESTIONS. BY USING OUR SERVICES OR REGISTERING FOR A COURSE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, OR YOU ARE NOT ABLE TO ENTER INTO A BINDING AGREEMENT, THEN YOU MAY NOT REGISTER FOR A COURSE OR USE OUR SERVICES.
General Terms and Conditions for Programs and Courses
1. Introduction

These Terms and Conditions outline the agreement between The Climate School SRL ("we," "us," "our") and the participant ("you," "your") of the Sustainability Accelerator Program ("Program").

This Agreement ("Terms") sets out the terms and conditions that govern your use of The Climate School's products and services (including website services and course content), as well as your registration for any course or other program ("Course") offered by The Climate School.

By agreeing to these Terms, you also consent to the following policies applicable to, and accessible on, our websites (including the website at theclimateschool.eco, and such other URLs that we may indicate from time to time ("Website/s")), which are incorporated by reference into these Terms: our Privacy Policy, Cookie Policy, Website Terms of Use, and any other policy that is made available on our Websites from time to time ("Policies").

2. Program and Course Offerings

Our Program includes either the Sustainability Professionals Accelerator or the Responsible Leaders Accelerator. Details are available on our website theclimateschool.eco

Our Courses include any courses listed on our website.

We reserve the right to modify the curriculum, instructors, dates, or delivery method as needed.

By clicking on the "I Accept the Terms and Conditions" button when signing up for a Program or Course, you agree to be bound by these "Terms", which include, by reference, the Policies.

3. Eligibility Criteria

Applicants must meet the eligibility criteria outlined in the Program description.

We reserve the right to deny admission if you do not meet eligibility requirements or if your application is deemed incomplete.

All information (including personal information) provided to us on registration, on creating an account, or while accessing The Climate School services and Courses, must be true, accurate and complete. You are also responsible for updating us in the event of a change to your information (for example, your name or address). All personal information will be processed following our Privacy Policy.
4. Application Process

Acceptance into the Program is at our sole discretion.

Before registering for any Course, you are responsible for establishing the relevance and suitability of the Course for your individual requirements, through consideration of the information supplied through our Websites, and asking questions (through our Contact form), if necessary.
5. Fees and Payment

Program fees are listed on our website.

Unless the contrary is stated on your invoice or information pack, the Course/ Program Fee charged by the company is inclusive of all Value Added Taxes, Goods and Services Taxes, duties, levies or charges, as determined and applicable based on the tax laws in Romania.

Upon acceptance and signing of the Program contract, an invoice will be issued. Payment is due within 5 days.

Non-payment may result in forfeiting your spot in the Program.

Sponsors: If your participation in a Course is being paid for by a third party, such as a sponsor or your employer (“sponsor”), then you are still bound by all provisions in these Terms (including payment provisions), however we may enter into a separate agreement with your sponsor to govern payment for and other terms related to the Course on your behalf, as well as to govern your sponsor’s receipt of certain information about your completion of the Course (“Sponsor Terms and Conditions”). Your ability to cancel or postpone your participation in a Course, as well as your sponsor’s eligibility for a refund of the Course fee, may be governed by the applicable Sponsor Terms and Conditions, and for the avoidance of doubt, Sponsor Terms and Conditions may supersede these Terms if agreed to between The Climate School and your Sponsor. You are responsible for communicating with your Sponsor about any agreed deviations from the Terms.

You will only receive confirmation of your registration for a Course or Program, and be allowed access to the Course or Program, once you (or your sponsor) have made the required minimum payment for the Course (unless otherwise specifically stated in the information pack relevant to your Course).

If there is a dispute about payment of any Course fee (or any portion thereof), or how you use the Website, we may at our sole discretion suspend your participation in the Course for the period of the dispute.
6. Course or Program Requirements

To register in, receive certain support, and complete a Course or Program you must be proficient in English (or as applicable, also the language the applicable Course is primarily offered in) and you will need a current valid email account and access to a computer and the internet. You should be familiar with using a computer and accessing the internet, as you may need to be able to read documents in Adobe PDF Reader, view Microsoft PowerPoint presentations, and read and create documents in Microsoft Word.

All Courses are designed and developed in collaboration with the relevant organisations and institutions. However, delivery of the Course is administered by The Climate School.

English is the primary language of instruction and administration for all Courses and Programs, and all coursework that is required for assessment purposes must be written in English unless indicated otherwise. Courses or Programs offered in a language other than English have been translated from English. When a Course or Program is presented in a different language (e.g.,Romanian), all coursework that is required must be written in the language of the Course or in English.

You may receive communication by telephone, email or text message from The Climate School team for Course/ Program administration and related purposes, including reminders of assignments and payments due by you, or other information related to your registration or these Terms. You agree and consent to receipt of such communications (although you may opt-out of any generic marketing communications that are unrelated to Course/ Progam administration, at any time, through the supplied opt-out mechanism).

Each Course is approved by The Climate School, and presented in collaboration with a reputable subject matter expert, or knowledge organisation. However, unless otherwise stipulated, these Courses and Programs are not accredited by that organisation neither by an educational institution. Nothing in these Terms establishes more than a very limited relationship between you and any organisation with which we collaborate or entitles you to use the resources of that organisation beyond participation in the Course/ Program unless expressly stated otherwise in relation to a particular Course./ Program.
7. Intellectual Property

Training materials provided are for your individual use during the Program. These materials remain our intellectual property or that of our content partners.

Distributing, sharing, or reproducing program materials without our written permission is prohibited.
8. Participation and Conduct
-
You are expected to attend live sessions and participate actively throughout the Program.

Disruptive behavior, disrespectful communication, or any form of discrimination will not be tolerated. We reserve the right to remove participants without a refund.
Cancellation & Refunds
-
If you wish to cancel your participation in a Course, you will need to contact our team at The Climate School to discuss your cancellation request.

Should you not be satisfied with the Course, a partial refund (for the remaining part of the Course/ Program) will be processed if you complete and submit the cancellation of registration application form to cancel your participation in a Course within 3 calendar days of the Course start date. If your Course fee has been paid by a sponsor, the refund of the Course fee will be made directly to your sponsor.

We reserve the right to cancel a Course if there is insufficient demand, as determined by us in our sole and absolute discretion. In this case, you will receive a full refund, but no interest will accrue on any amounts refunded to you and any applicable bank charges will be offset against the refunded amount.
9. Certificate of Completion

Upon successful completion of the Program requirements, you will receive a Sustainability Accelerator certificate.
10. Disclaimer

While we strive to provide excellent training, we do not guarantee specific job outcomes or promotions as a result of the Program.

We will not, under any circumstances, be liable for any costs, claims, damages, or loss that you may sustain or suffer as a result of registering for and/or participating in any Course (or other services offered by us) which is not relevant, suitable or does not meet your requirements, and/or the requirements of any relevant industry or commercial body. Under no circumstances do we guarantee your suitability for a particular Course based on the levels of difficulty. We cannot, under any circumstances, be held liable to you for any costs, claims, damages or loss, if after the completion of a Course you are not able to obtain employment or a promotion within your chosen field of study, or attain any other outcome you may believe completing a Course will assist you to attaining.

To the extent permissible under applicable laws, all services, Courses and their content are provided "as is” without representations or warranties of any kind, whether express or implied, in respect thereof, and in particular, we make no representations or warranties regarding the quality of the Course content or the fitness of the Course content for the purpose for which you acquired it.

We are not responsible for any actions you take based on knowledge gained in the Program. You are solely responsible for your decisions and actions in your career and business.
11. Limited Liability

We are not liable for technical issues beyond our control, indirect, or consequential damages you may incur due to participation in the program.

We are constantly changing and improving our services and Courses. We may add or remove functions, features, or requirements, and we may suspend or stop our service altogether, giving enrolled students reasonable prior notice of any material changes, as possible. You may also discontinue your use of our services and Courses at any time, without being entitled to any refund.
12. Data Privacy

Data collected through your application and participation is governed by our Privacy Policy.
13. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions. Changes will be posted on our website.

If any aspect of these Terms conflicts with any information provided on our Website or in information packs or other Course / Program materials, these Terms will prevail unless expressly stated otherwise.
14. Governing Law

These Terms and Conditions are governed by Romanian law. Any disputes shall be resolved in the appropriate Romanian courts.
15. Agreement

These Terms, together with the Policies, shall constitute the entire agreement between you and The Climate School concerning your registration for and participation in a Course.

By submitting your application and being accepted into the Program, you mark your agreement to these Terms and Conditions.
